2016 Hospitality Law Conference

David is excited to be presenting again at the annual Hospitality Law Conference. This year his session is entitled FACT OR FICTION: Dealing with Guest Claims (Real & Imagined).

It seems that incidents of guests claiming (usually after the fact) that they have suffered some injury or illness due to the restaurant are on the rise. When you get the "I broke my tooth at your restaurant,” or “you guys made me sick last week,” call, or any of the other innumerable allegations (scams?) that come in, what do you do? Who do you call first? Your insurance company? Attorney? Mom? This session will explore what to take seriously, how to respond, and when to get your insurance company involved.

The firm had a great time hosting the First Annual DFW Restaurateurs' Conference at 3015 Trinity Groves. Local restaurant industry owners and executives attended talks by the firm's attorneys on various hot topics in restaurant law, listened to panels featuring real estate and food media professionals, and enjoyed a networking cocktail hour featuring local mixologists. 2015 Hospitality Law Conference

This year David presented Avoiding and Surviving Food-related Claims (illness, allergy, and plain old bad luck) to the 2015 Hospitality Law Conference.

Even the most vigilant food and beverage operation can come under fire from food-related claims. This session will explore recent cases involving food-related claims, and explore what you can do to avoid or address such an incident. Training on proper policies and procedures is the first line of defense against these claims, but occasionally they occur. Steps taken immediately following an incident, such as the collection and preservation of physical evidence, recording employee statements, and public relations readiness, can make the difference between winning and losing a claim.

2015 San Antonio Cocktail Conference

David had an absolute blast presenting at SACC with Jason Kosmas, co-founder of both the Employees Only bar (winner of World's Best Cocktail Bar at 2011 Tales of the Cocktail) and 86 Co. Spirits. Together they presented Deadly Games: Nitrogen, Fire & Stupidity.

The session discussed some significant examples from around the world involving the dangerous service of alcohol. Practices such as using liquid nitrogen and fire as ingredients, pyrotechnic displays of stupidity behind the bar, or the failure to implement solid policies and procedures governing the service of alcohol, David and Jason explored how bar owners put themselves at risk for little financial upside. From dangerous service to dram shop liability, bar owners and professionals learned from actual examples, with takeaways to directly impact their businesses upon returning home. They also discussed tips for the responsible service of alcohol, avoiding liability in the service of food and beverages.

National Constitution Center Webinar

On May 29, David presented a 90-minute webinar on Negotiating Restaurant Leases. The restaurant lease can be one of the most problematic of landlord-tenant agreements due to the many issues concerning property use, exclusivity and operating issues. A well-thought-out lease can be the difference between a restaurant thriving or closing. David discussed the most important aspects of the restaurant lease, including considerations of use, permitting, assignment, alcoholic beverages, expenses, and a host of other hospitality-specific issues.

On May 15, 2014, David presented Foodborne Illnesses and Allergies: Trends and Issues with Goodloe Partee, General Counsel of American Blue Ribbon Holdings.

David reviewed some significant court cases from across the country involving the service of food and alcohol, including foodborne illness, allergies, dangerous foods/drinks, and dram shop/alcohol. He also discussed recent menu labeling legislation, as well as highlights from recently-proposed FDA menu labeling regulations. On February 4, 2010, David presented The Modern Menu: Warnings, Disclaimers, and Nutrition Labeling at the 8th Annual Hospitality Law Conference. This session focused on the legal aspects of menu design, including the use of warnings and disclaimers to avoid (or limit) liability for foodborne illness and allergic reactions. The session also addressed existing nutrition labeling laws, as well as proposed national menu labeling legislation.
